NEWTON, Mass. (AP) — A pro-Israel rally in a Boston suburb turned violent Thursday evening when a passerby was shot during a scuffle after confronting a group of demonstrators, authorities said.

Police were called at 6:40 p.m. to the scene of what they described as a small rally in Newton. Words were exchanged before a passerby rapidly crossed the street and tackled one of the demonstrators, Middlesex County District Attorney Marian Ryan said.

“A scuffle ensued. During that scuffle, the individual who had come across the street was shot by a member of the demonstrating group,” Ryan said during a news conference late Thursday.

Scott Hayes, 47, of Framingham, was arrested on charges of assault and battery with a dangerous weapon and violation of a constitutional right causing injury. He pleaded not guilty to the charges.

Hayes, who works as a contractor for National Grid, was ordered to be fitted with a GPS monitor and to stay away both from the city of Newton and from the individual who had been shot and to not be in possession of a dangerous weapon.

Hayes, who appeared to have bruising to his face during his court appearance Friday afternoon, was also required to post a $5,000 cash bail and to abide by a 7 p.m. to 6 a.m. curfew.

“This is a textbook case of self defense,” said Glenn MacKinlay, an attorney representing Hayes. “We’re confident that the investigation, when it’s completed, will clear Mr. Hayes of all charges.”

Prosecutors also told the court that an application for a criminal complaint has been applied for against the individual who was shot, identified as Caleb Gannon of Newton. He was being treated at a hospital.

They said they opted for an application for a criminal complaint instead of an arrest because the alleged assault and battery was not committed in the presence of a police officers.

Acting Newton Police Chief George McMains asked witnesses to provide investigators with photos or videos of the confrontation. He said police would provide extra patrols at “houses of worship” over the next several days.

Newton Mayor Ruthanne Fuller called the shooting a “frightening incident” and asked for everyone to remain calm as police investigate.

“I know people will have a lot of questions, and we will share information with Newtonians and the press when we are able,” Fuller said. “It’s really early stages of an active investigation.”

SPRINGFIELD, Ohio — A sleepy Ohio city-turned-center of the political universe has faced an onslaught of bomb threats in recent weeks over baseless conspiracy theories about its population of Haitian migrants.

Now it’s bracing for another challenge: A possible visit from Donald Trump.

The former president — who threw Springfield, Ohio, into disarray earlier this month when he falsely claimed an “invasion” of Haitian migrants here were eating cats, dogs and geese — declared at a recent campaign rally that he planned to visit the city in the coming weeks, though it’s unclear if he actually will come. And although he has not announced an appearance date, some residents are welcoming the visit — while others are readying themselves for impact.

“I think everybody needs to be heard, but I feel like you’re adding fuel to the fire,” said Amanda Jones, a nurse practitioner in the area. “Resources are already spread super thin in this area, not only for the people’s safety that’s going to attend, but also for the candidate’s safety as well, because it’s a very divisive time right now.”

Springfield Mayor Rob Rue, a Republican, urged Trump not to come, saying during a press conference last week it would “undoubtedly place additional demands on our safety infrastructure.”

“Should he choose to change his plans, it would convey a significant message of peace to the city of Springfield,” Rue said, adding that the city is “committed to ensuring that the event proceeds safely and smoothly for both the residents and visitors.”

Trump’s campaign did not provide specifics on Trump’s plans to visit to Springfield. In a statement, Trump campaign national press secretary Karoline Leavitt said: “While the media may find these stories and experiences unimportant and inconvenient, President Trump will continue giving a voice to Americans who are expressing their concerns about the influx of illegals and rising migrant crime in their communities.”

As of Wednesday morning, the Secret Service — which coordinates campaign event safety with state and local law enforcement — had not informed the state of a planned visit, according to Andy Wilson, director of the Ohio Department of Public Safety.

Still, Wilson said, “obviously, if he comes, it won’t be a surprise.” He promised that state and local law enforcement “will be equipped to handle whatever comes our way.”

A group of congressional Democrats is also planning a trip to Springfield in solidarity with the migrants, Rep. Sheila Cherfilus-McCormick (D-Fla.) — who is Haitian American — said Friday at a news conference. Members of the congressional Haitian Caucus on Friday introduced a resolution to condemn racism against the Haitian community.

In the weeks since Trump first claimed at the presidential debate that Haitian migrants were eating pets — which Springfield officials have repeatedly denied — the small Ohio city has contended with dozens of threats that have shuttered schools, government buildings, hospitals and stores.

Police have erected watch towers throughout the city, which now has a pack of bomb-sniffing dogs and a cadre of state law enforcement personnel ready to respond at a moment’s notice, according to Wilson. Republican Ohio Gov. Mike DeWine — who on Friday criticized Trump and his running mate, Ohio Sen. JD Vance, for “rhetoric” he said “hurts the city and its people” — stationed state troopers at each of Springfield’s public schools for the duration of each school day.

“Locally, the resources are stretched thin, there’s no doubt about it,” Wilson said. But, he added: “The fact that we have a bunch of resources over there already, from a state perspective, makes [a Trump visit] less logistically heavy for us, actually.”

Some residents of Springfield and the surrounding area told POLITICO they were concerned a Trump visit would inflame tensions.

“I definitely don’t want him coming to Ohio,” said Judy Shaw, a Democrat who had joined her Republican partner to attend a town hall with Trump surrogate Vivek Ramaswamy. “I think it wouldn’t bring anything good.”

this paragraph commits a felony of the first degree, punishable as
provided in s. 775.082, s. 775.083, or s. 775.084,
and shall be sentenced to a mandatory minimum term of imprisonment of 4
years. A person who willfully commits such a violation while driving
under the influence as set forth in s. 316.193(1) shall be sentenced to a mandatory minimum term of imprisonment of 4 years.
(d) Notwithstanding s. 775.089(1)(a),
if the driver of a vehicle violates paragraph (a), paragraph (b), or
paragraph (c), the court shall order the driver to make restitution to
the victim for any damage or loss unless the court finds clear and
compelling reasons not to order the restitution. Restitution may be
monetary or nonmonetary restitution. The court shall make the payment of
restitution a condition of probation in accordance with s. 948.03.
An order requiring the defendant to make restitution to a victim does
not remove or diminish the requirement that the court order payment to
the Crimes Compensation Trust Fund under chapter 960. Payment of an
award by the Crimes Compensation Trust Fund creates an order of
restitution to the Crimes Compensation Trust Fund unless specifically
waived in accordance with s. 775.089(1)(b).
(e) A
driver who violates paragraph (a), paragraph (b), or paragraph (c)
shall have his or her driver license revoked for at least 3 years as
provided in s. 322.28(4).
1. A
person convicted of violating paragraph (a), paragraph (b), or
paragraph (c) shall, before his or her driving privilege may be
reinstated, present to the department proof of completion of a victim’s
impact panel session in a judicial circuit if such a panel exists, or if
such a panel does not exist, a department-approved driver improvement
course relating to the rights of vulnerable road users relative to
vehicles on the roadway as provided in s. 322.0261(2).
2. The
department may reinstate an offender’s driving privilege after he or
she satisfies the 3-year revocation period as provided in s. 322.28(4)
and successfully completes either a victim’s impact panel session or a
department-approved driver improvement course relating to the rights of
vulnerable road users relative to vehicles on the roadway as provided in
s. 322.0261(2).
3. For
purposes of this paragraph, an offender’s driving privilege may be
reinstated only after the department verifies that the offender
participated in and successfully completed a victim’s impact panel
session or a department-approved driver improvement course.
(f) For
purposes of sentencing under chapter 921 and determining incentive
gain-time eligibility under chapter 944, an offense listed in this
subsection is ranked one level above the ranking specified in s. 921.0022 or s. 921.0023 for the offense committed if the victim of the offense was a vulnerable road user.
(g) The
defendant may move to depart from the mandatory minimum term of
imprisonment prescribed in paragraph (c) unless the violation was
committed while the defendant was driving under the influence. The state
may object to this departure. The court may grant the motion only if it
finds that a factor, consideration, or circumstance clearly
demonstrates that imposing a mandatory minimum term of imprisonment
would constitute or result in an injustice. The court shall state in
open court the basis for granting the motion.
(3) The
stops shall be made without unnecessarily obstructing traffic, and, if a
damaged vehicle is obstructing traffic, the driver of the vehicle shall
make every reasonable effort to move the vehicle or have it moved so as
not to obstruct the regular flow of traffic. A person who fails to
comply with this subsection shall be cited for a nonmoving violation,
punishable as provided in chapter 318.
(4)(a) In
addition to any other civil, criminal, or administrative penalty
imposed, a person whose commission of a noncriminal traffic infraction
or a violation of this chapter or s. 1006.66
causes or results in the death of another person may be required by the
court to serve 120 community service hours in a trauma center or
hospital that regularly receives victims of vehicle accidents, under the
supervision of a registered nurse, an emergency room physician, or an
emergency medical technician pursuant to a voluntary community service
program operated by the trauma center or hospital.
(b) Notwithstanding
paragraph (a), in addition to any other civil, criminal, or
administrative penalty imposed, a person whose commission of a violation
of s. 316.172(1)(a) or (b) causes or results in serious bodily injury to or death of another person shall be required by the court to:
1. Serve
120 community service hours in a trauma center or hospital that
regularly receives victims of vehicle accidents, under the supervision
of a registered nurse, an emergency room physician, or an emergency
medical technician pursuant to a voluntary community service program
operated by the trauma center or hospital.
2. Participate
in a victim’s impact panel session in a judicial circuit if such a
panel exists, or if such a panel does not exist, attend a
department-approved driver improvement course relating to the rights of
vulnerable road users relative to vehicles on the roadway as provided in
s. 322.0261(2).
(5) This section does not apply to crashes occurring during a motorsports event, as defined in s. 549.10(1), or at a closed-course motorsport facility, as defined in s. 549.09(1).

⁣316.027 Crash involving death or personal injuries.—
(1) As used in this section, the term:
(a) “Serious
bodily injury” means an injury to a person, including the driver, which
consists of a physical condition that creates a substantial risk of
death, serious personal disfigurement, or protracted loss or impairment
of the function of a bodily member or organ.
(b) “Vulnerable road user” means:
1. A
pedestrian, including a person actually engaged in work upon a highway,
or in work upon utility facilities along a highway, or engaged in the
provision of emergency services within the right-of-way;
2. A person operating a bicycle, an electric bicycle, a motorcycle, a scooter, or a moped lawfully on the roadway;
3. A person riding an animal; or
4. A person lawfully operating on a public right-of-way, crosswalk, or shoulder of the roadway:
a. A farm tractor or similar vehicle designed primarily for farm use;
b. A skateboard, roller skates, or in-line skates;
c. A horse-drawn carriage;
d. An electric personal assistive mobility device; or
e. A wheelchair.
(2)(a) The
driver of a vehicle involved in a crash occurring on public or private
property which results in injury to a person other than serious bodily
injury shall immediately stop the vehicle at the scene of the crash, or
as close thereto as possible, and shall remain at the scene of the crash
until he or she has fulfilled the requirements of s. 316.062. A person who willfully violates this paragraph commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(b) The
driver of a vehicle involved in a crash occurring on public or private
property which results in serious bodily injury to a person shall
immediately stop the vehicle at the scene of the crash, or as close
thereto as possible, and shall remain at the scene of the crash until he
or she has fulfilled the requirements of s. 316.062. A person who willfully violates this paragraph commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(c) The
driver of a vehicle involved in a crash occurring on public or private
property which results in the death of a person shall immediately stop
the vehicle at the scene of the crash, or as close thereto as possible,
and shall remain at the scene of the crash until he or she has fulfilled
the requirements of s. 316.062.
A person who is arrested for a violation of this paragraph and who has
previously been convicted of a violation of this section, s. 316.061, s. 316.191, or s. 316.193, or a felony violation of s. 322.34,
shall be held in custody until brought before the court for admittance
to bail in accordance with chapter 903. A person who willfully violates
this paragraph commits a felony of the first degree, punishable as
provided in s. 775.082, s. 775.083, or s. 775.084,
and shall be sentenced to a mandatory minimum term of imprisonment of 4
years. A person who willfully commits such a violation while driving
under the influence as set forth in s. 316.193(1) shall be sentenced to a mandatory minimum term of imprisonment of 4 years.
(d) Notwithstanding s. 775.089(1)(a),
if the driver of a vehicle violates paragraph (a), paragraph (b), or
paragraph (c), the court shall order the driver to make restitution to
the victim for any damage or loss unless the court finds clear and
compelling reasons not to order the restitution. Restitution may be
monetary or nonmonetary restitution. The court shall make the payment of
restitution a condition of probation in accordance with s. 948.03.
An order requiring the defendant to make restitution to a victim does
not remove or diminish the requirement that the court order payment to
the Crimes Compensation Trust Fund under chapter 960. Payment of an

imprisonment prescribed in paragraph (c) unless the violation was
committed while the defendant was driving under the influence. The state
may object to this departure. The court may grant the motion only if it
finds that a factor, consideration, or circumstance clearly
demonstrates that imposing a mandatory minimum term of imprisonment
would constitute or result in an injustice. The court shall state in

(3) The
stops shall be made without unnecessarily obstructing traffic, and, if a
damaged vehicle is obstructing traffic, the driver of the vehicle shall

(4)(a) In
addition to any other civil, criminal, or administrative penalty

court to serve 120 community service hours in a trauma center or
hospital that regularly receives victims of vehicle accidents, under the

program operated by the trauma center or hospital.
(b) Notwithstanding
paragraph (a), in addition to any other civil, criminal, or
administrative penalty imposed, a person whose commission of a violation
of s. 316.172(1)(a) or (b) causes or results in serious bodily injury to or death of another person shall be required by the court to:
1. Serve
120 community service hours in a trauma center or hospital that
regularly receives victims of vehicle accidents, under the supervision
of a registered nurse, an emergency room physician, or an emergency
medical technician pursuant to a voluntary community service program
operated by the trauma center or hospital.
2. Participate
in a victim’s impact panel session in a judicial circuit if such a
panel exists, or if such a panel does not exist, attend a
department-approved driver improvement course relating to the rights of
vulnerable road users relative to vehicles on the roadway as provided in
s. 322.0261(2).
(5) This section does not apply to crashes occurring during a motorsports event, as defined in s. 549.10(1), or at a closed-course motorsport facility, as defined in s. 549.09(1).

⁣316.027 Crash involving death or personal injuries.—
(1) As used in this section, the term:
(a) “Serious

until he or she has fulfilled the requirements of s. 316.062. A person who willfully violates this paragraph commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(b) The
driver of a vehicle involved in a crash occurring on public or private
property which results in serious bodily injury to a person shall
immediately stop the vehicle at the scene of the crash, or as close
thereto as possible, and shall remain at the scene of the crash until he
or she has fulfilled the requirements of s. 316.062. A person who willfully violates this paragraph commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(c) The
driver of a vehicle involved in a crash occurring on public or private
property which results in the death of a person shall immediately stop
the vehicle at the scene of the crash, or as close thereto as possible,
and shall remain at the scene of the crash until he or she has fulfilled
the requirements of s. 316.062.
A person who is arrested for a violation of this paragraph and who has
previously been convicted of a violation of this section, s. 316.061, s. 316.191, or s. 316.193, or a felony violation of s. 322.34,
shall be held in custody until brought before the court for admittance
to bail in accordance with chapter 903. A person who willfully violates
this paragraph commits a felony of the first degree, punishable as
provided in s. 775.082, s. 775.083, or s. 775.084,
and shall be sentenced to a mandatory minimum term of imprisonment of 4
