Trump Lawyer Argues ‘Appearance of Impropriety’ Is Enough to Disqualify Prosecutor

Lawyers argued about whether the prosecutor Fani Willis has an untenable conflict of interest in the Georgia election case; her side called the disqualification effort “desperate.”

A judge in the Georgia election interference case against former President Donald J. Trump heard final arguments on Friday on a motion to disqualify the prosecutor who brought the case, Fani T. Willis, on the ground that a romantic relationship she had with a subordinate created a conflict of interest.

With a historic criminal case against a former president on the line, lawyers for Mr. Trump and his co-defendants took turns assailing Ms. Willis. John B. Merchant III, who represents the defendant Michael Roman, said that if the court finds the prosecutors’ romance did not create a conflict of interest, “public confidence in the system will be shot.”

But Adam Abbate, a prosecutor in Ms. Willis’s office, called the defense’s effort to disqualify


Ms. Willis “a desperate attempt to remove a prosecutor from a case for absolutely no reason, other than harassment and embarrassment.”

Defense lawyers on Friday repeatedly asserted that the bar for disqualification should be relatively low, arguing that even the appearance of a conflict of interest should lead to Ms. Willis’s removal from the case because her actions had undermined public confidence in it.


The question of whether the defense needs to show an actual conflict or just an appearance of one could prove pivotal.

“We can demonstrate an appearance of a conflict of interest, and that is sufficient,” Mr. Merchant told the judge, Scott McAfee of Fulton County Superior Court.

Mr. Trump’s lawyer, Steven H. Sadow, picked up the theme, arguing that “once you have the appearance of impropriety,” the law in Georgia is clear: “That’s enough to disqualify.”

Mr. Sadow focused on a speech Ms. Willis made in January at a Black church in Atlanta, calling her remarks a “violation of professional rules of conduct.”

Her speech, at Big Bethel African Methodist Episcopal Church, came shortly after the conflict-of-interest motion was filed.

Ms. Willis, who is Black, suggested in the speech that the scrutiny of her romantic relationship with the prosecutor she hired to run the Trump case, Nathan Wade, was racist. Some of those comments she described as part of a conversation she had with God.

“It was a calculated determination by Ms. Willis to prejudice the defendants and their counsel,” Mr. Sadow said, adding, “Can you think of anything more that would heighten public condemnation of the defendant than alleging that the defense counsel and the defendants were making their motion based on race and religion?”

With Ms. Willis seated silently at the prosecution table, Mr. Abbate told Judge McAfee that appearance alone was not enough to disqualify her.

“The defense has to show an actual conflict,” Mr. Abbate said, adding that it had not done so in this case.

After Mr. Abbate sought to bolster his argument by citing a number of prior cases in which a conflict of interest had been found, Judge McAfee interjected that “a number of these cases seem to rely on appearance of impropriety.” But Mr. Abbate said that in each of the cases of disqualification that he cited, the courts found an “actual conflict” in addition to the appearance of impropriety.

The legal arguments of Mr. Trump and his allies were advanced by a lineup of veteran defense lawyers who seemed quite at ease, while Mr. Abbate had a more halting, and at times fumbling, presentation, relying more on his recitation of precedent and case law.

Regardless, Judge McAfee will be more interested in the substance of the legal questions, rather than the delivery style. He said after the arguments that he would rule within two weeks.

The hearing Friday allowed lawyers from the two sides to sum up their arguments over a salacious subplot to the election case — one that has already caused significant embarrassment and turmoil for Ms. Willis, the Fulton County district attorney. Details of her personal life have been spilled out in the Atlanta courthouse where she had hoped to put Mr. Trump and 14 co-defendants on trial as soon as this summer.

⁣The stakes are high: If Ms. Willis is disqualified from the case, her entire office will be, too, and the case will probably be turned over to a district attorney from another jurisdiction. The new prosecutor could choose to continue the case as planned, modify the charges or drop them.

Disqualification would reduce the chances that a trial would begin before the November presidential election, in which Mr. Trump is expected to be the Republican nominee.

The relationship between Ms. Willis and Mr. Wade, an Atlanta-area lawyer she hired in November 2021 to manage the prosecution team, first came to light in January, in a motion filed by Ashleigh Merchant, a lawyer for Michael Roman, one of Mr. Trump’s co-defendants.

Ms. Merchant, who along with her husband, John Merchant, represents Mr. Roman, asserted that the romance began before Ms. Willis hired Mr. Wade. She also argued that Mr. Wade was unqualified for the high-profile job, for which he has been paid at least $650,000 so far.

Ms. Merchant claimed that Mr. Wade and Ms. Willis had engaged in “self-dealing,” because the couple went on vacations together that she said Mr. Wade had paid for.
In her filing on Jan. 8, Ms. Merchant cited Georgia case law in arguing that the situation as she laid it out met the standard for a disqualifying conflict of interest.

On Friday, Mr. Merchant told the judge that “we have here a very personal financial interest that’s been laid out in terms of money received by Ms. Willis, as a result of the scheme that she set up.”

Ms. Willis and Mr. Wade have acknowledged that they had a romantic relationship. But they have said that it began after Mr. Wade was hired, and that it ended before Mr. Trump and 18 of his allies were charged in August in a sweeping indictment that accuses them of conspiring to overturn Mr. Trump’s defeat in the 2020 election.


⁣The Accusations Against Fani WillisThe election interference case in Georgia against former President Donald Trump has been buffeted by an effort to disqualify Fani Willis, the main prosecutor, over her romantic relationship with a colleague.

What to Know: A tense hearing was held in Georgia to decide whether Willis and her office should be removed from the prosecution. Here is what we learned during the first and second days of the proceedings.

The Accusations: Trump’s lawyers are hoping to convince a judge that Willis’s relationship with Nathan Wade, a lawyer she hired to manage the case, has created a conflict of interest that should be grounds for disqualifying Willis.

Willis’s Response: In a court filing and in a raw testimony, Willis said that her relationship with Wade began after she hired him to join the case and ended in 2023, arguing that the romance should not be a reason to disqualify her.

A Messy Diversion: Regardless of whether Willis is disqualified from leading the high-stakes case against Trump in Georgia, the extraordinary detour it has taken may have changed it fundamentally.

Ms. Willis said the couple roughly split the costs of the trips they took together, with Ms. Willis often using cash to pay back Mr. Wade for her share.

One defense lawyer, Richard A. Rice, Jr., accused the prosecutors during Friday’s hearing of living “Robin Leach’s lifestyle of the rich and famous” on their vacations.

But Mr. Abbate scoffed at that: “The evidence was she stayed at a DoubleTree in Napa” he said of Ms. Willis. “I don’t know that to be a lavish hotel.”

The judge held a series of hearings on the issue in February that felt at times like a mini-trial.


Mr. Wade took the stand, as did Ms. Willis, who pushed back angrily against Ms. Merchant’s questions. Ms. Willis described feeling loneliness after becoming the district attorney, the violent threats and racist messages she had received, and her frustration that the focus on her love life had distracted the nation’s attention from Mr. Trump and the 14 co-defendants who remain after four of those originally charged pleaded guilty.

At a hearing on Tuesday, the conflicting accounts of when the prosecutors’ romance began took center stage. Ms. Merchant called Terrence Bradley, a former law partner of Mr. Wade, to the stand, hoping to help prove that the relationship began before Mr. Wade was hired.

But Mr. Bradley delivered contradictory information. Entered into evidence was a text exchange he had with Ms. Merchant months earlier, in which he said that the relationship “absolutely” predated Mr. Wade’s hiring. But on the witness stand, he repeatedly said he had no knowledge of when the romance began.

The judge will have to decide which of Mr. Bradley’s accounts to believe as he weighs whether to disqualify the prosecutors.

At Friday’s hearing, Mr. Sadow said Mr. Bradley’s text messages showed that the relationship began before Mr. Wade’s hiring. But the judge seemed uncertain.

“Is it ever definitively shown how he knew this and that he actually did know it?” Judge McAfee asked.

Another witness, a former friend and employee of Ms. Willis named Robin Yeartie, also testified that the relationship predated Mr. Wade’s hiring. But under cross-examination, she said that she had left the D.A.'s office on bad terms and was no longer Ms. Willis’s friend.
Mr. Abbate on Friday dismissed both Mr. Bradley and Ms. Yeartie as people who had an ax to grind with the prosecutors.

There is already some precedent within the Trump case for disqualification. In July 2022, a judge blocked Ms. Willis from developing a case against Burt Jones, a fake Trump elector in Georgia in 2020, because Ms. Willis had hosted a fund-raiser for one of Mr. Jones’s political rivals. A year and a half after the disqualification, no replacement prosecutor has yet been named to continue investigating Mr. Jones, who is now Georgia’s lieutenant governor.

Pete Skandalakis, the executive director of the Prosecuting Attorneys’ Council of Georgia, said in a recent interview that the current situation was different from the one involving Mr. Jones and suggested that it could move more quickly because an indictment has already been handed up.

While discussing the former Fox News anchor's interview on the Patrick Bet-David podcast Friday, Owens praised the Russian president's intelligence and said it made him look smart compared to Joe Biden.
Cuomo criticized the firebrand for praising the leader. The NewsNation host added that Putin has had his enemies killed and limits Russian citizens' freedom.
'You just got triggered by the fact that I acknowledged that Putin...' Owens said before Cuomo cut her off.
'I am not triggered, what are you 19? What, are you using 19-year-old woke language now, that I'm triggered? I'm not triggered,' Cuomo said.
Owens said Putin's explanation of Russian history was impressive and intelligent compared to Biden's often gaffe-filled speeches.
'Tucker just went over and interviewed Vladimir Putin and this is significant because then you saw what it looks like when somebody not only has the mental faculty, I mean irrespective of what you thought about the interview, you are forced to acknowledge that he's an incredibly smart person,' said Owens.
'It's very obvious that Putin can complete a sentence and that Biden can't.'
During the interview, Putin gave a 'historical background' of the conflict with Ukraine, before defending his military's action.
He then went on to make a range of bombshell claims including that Bill Clinton offered Russia a place in NATO, Russia has superior 'supersonic missiles,' Wall Street Journal reporter Evan Gershkovich is a 'spy' and said the CIA blew up the Nord Stream Pipeline.
Cuomo was outraged by Owens' notion that Americans should want a leader like Putin.
'You [the audience] think he [Putin] gave you an accurate recitation of Russian history starting in the 8th century because Candace just said so,' Cuomo said.
'She's wrong and you're wrong okay? He did not give you an accurate recitation he gave you a KGB doctored look at why it's okay that he wants to reestablish the Soviet Union.'
Owens defended herself from Cuomo's criticism and said calling Putin smart does not mean she supports him.
'Chris, there's no reason to do this, there's no reason to do this. You're doing so great, I'm not going to let you do this to yourself,' Owens said.
'Seriously, there is no reason to do it. Obviously Vladimir Putin is intelligent. In the Carlson interview, when asked what the decisive moment was that made up his mind to launch his attack, Putin responded, 'initially, it was the coup in Ukraine' - referencing the removal of Zelensky's predecessor Viktor Yanukovych in 2014.
'And what triggered the current events? Firstly, the current Ukrainian leadership would not implement the Minsk Agreements,' Putin continued. The Minsk Agreements were a series of treaties that sought to end the Donbas War between Ukraine and Russian separatist groups, signed in 2014.
He accused former leaders of Germany and France of reneging on their commitments to the agreements.
'They never intended to implement them, they simply led us by the nose,' he said.
He also bristled at the notion a change in president would change the outcome of the war.
'You just asked me if another leader comes and changes something? It is not about the leader,' he said.
Putin sensationally claimed that a peace deal over the Ukraine war was once almost agreed to, blaming the 'Western side' for wanting to keep the war going for as long as possible.
'We're willing to negotiate,' he said.

An animal brought to the Temple in Jerusalem as a sacrifice must be free of physical deformities or blemishes. One of these is a film over the cornea or, according to some, over the eyelid. The word duk (דק), which in modern Hebrew means thin, is translated as either a cataract (Soncino and Schottenstein) or “a veiled or withered spot” (Jastrow).
RASHI AND THE MEANING OF דֹּק
To better understand the etymology of the word, Rashi draws our attention to the verse in Isaiah (40:22 ) הַנּוֹטֶה כַדֹּק שָׁמַיִם וַיִּמְתָּחֵם כָּאֹהֶל לָשָׁבֶת “Who spread out the skies like a film [כַדֹּק], stretched them out like a tent to dwell in.” He notes that in the French of his day the the word for דֹּק is “teile” or toile, (טייל׳א or טולא) meaning a canvas or fabric. So the Talmud is describing a film over the eye, and this is certainly a reasonable way to describe a cataract, which is a cloudiness of the lens in the eye. In a cow it would look like this:

Rashi then gives an alternative meaning for the word: a blemish on the eyelids. He continues

We read about this in homiletic stories: The eye is a mini representation of the world. The upper eyelid represent the rakia (the vault over the sky that contains the stars) and the lower lid represents the earth. The white of the eye [the conjunctiva] represents the ocean that encircles the world, and the dark part which is circular [the pupil] represents the orbit of the sun.
Rashi seems to suggest that since the upper eyelid is described as representing the skies, which are stretched out like a canvas, working backwards the word דֹּק could mean the eyelid. The aggadic (homiletic) parable to which Rashi is referring is from Derech Eretz Zuta, a minor tractate of the Talmud (and not part of the daily one-page a day cycle). Here it is, from the end of the ninth chapter:

The world can be compared to the eyes of a person. The whites of the eyes are the ocean that encircles the entire world. The dark part (? the ring around the iris) is the world, the iris [lit. the folded part of the pupil] is Jerusalem, and the pupil [lit image in the iris] is the Temple, may it be rebuilt speedily and in our days and the days of all of Israel, Amen.
TWO MAPS OF THE WORLD
So we have two ways in which eye might echo a map of the world. And although it is not entirely clear what the terms קומט שבשחור and פרצוף שבקומט mean, the maps look something like this:
Both of these “eye maps” capture elements of talmudic geography. In the talmudic mind, the Earth was a flat disc covered by an opaque sky known as the rakia. Exactly how the sun moved was the topic of a famous dispute between the “wise men of Israel” and the “wise Gentiles.” Here it is:

Construction finished earlier this year and the house didn't have time to hit the open market before Diddy snapped it up in an off-market deal.

The property include a pool and grotto connected by an underwater tunnel, a 35-seat theater, a wine room, and a "steam room, massage room and beauty salon" in a separate structure on-site, according to TMZ. With his new address, Diddy will now be a neighbor to the Playboy Mansion and the equally infamous The Manor, which has a climate-controlled attic that's the same size as Diddy's new place.

The heifer was to be wholly burned. This typified the painful sufferings of our Lord Jesus, both in soul and body, as a sacrifice made by fire, to satisfy God's justice for man's sin. These ashes are said to be laid up as a purification for sin, because, though they were only to purify from ceremonial uncleanness, yet they were a type of that purification for sin which our Lord Jesus made by his death. The blood of Christ is laid up for us in the word and sacraments, as a fountain of merit, to which by faith we may have constant recourse, for cleansing our consciences.

Why did the law make a corpse a defiling thing? Because death is the wages of sin, which entered into the world by it, and reigns by the power of it. The law could not conquer death, nor abolish it, as the gospel does, by bringing life and immortality to light, and so introducing a better hope. As the ashes of the heifer signified the merit of Christ, so the running water signified the power and grace of the blessed Spirit, who is compared to rivers of living water; and it is by his work that the righteousness of Christ is applied to us for our cleansing. Those who promise themselves benefit by the righteousness of Christ, while they submit not to the grace and influence of the Holy Spirit, do but deceive themselves; we cannot be purified by the ashes, otherwise than in the running water. What use could there be in these appointments, if they do not refer to the doctrines concerning the sacrifice of Christ? But comparing them with the New Testament, the knowledge to be got from them is evident. The true state of fallen man is shown in these institutions. Here we learn the defiling nature of sin, and are warned to avoid evil communications.

I was NOT aware that Chancellor Palpatine was the Emperor until Revenge of the Sith.

How was that possible?!?

Until recently, I had not seen Return of the Jedi…and I have only a one-word answer to that:

Ewoks.

I could never make sense of how it was that little furry creatures lived in a bloody forest. It smacked of pandering to the fairer sex, who, I imagine, after first seeing the little buggers, practically cooed in the ears of anyone within earshot.

When Star Wars came out, I took the book with me, and read it while the movie played.

When Empire Strikes Back first showed, I had to leave because my sister freaked out when Han cut into the Taun-taun to keep Luke safe from the elements on Hoth. I got to see it not too long after that.

I never saw RotJ in the theater.

When the Phantom Menace came out, I thought that there was something a tad “off” about the Chancellor…but I couldn’t really put my finger on it.

Attack of the Clones should have made it clear that he was up to no good, but I simply didn’t have that prior knowledge.

Of course, it all came together in Revenge of the Sith – though his conversion to the Dark Side was clumsily done.

Now, you think I would have consulted some Star Wars Wiki that would ostensibly explain how Ewoks could live in a forest…but I didn’t much care…until I’d seen a promo of RotJ with the Emperor blasting Luke with Force Lightning.

Now I had to see it!

I sat through the bloody forest scenes, and got my payoff. Of course, I cannot find examples of other Jedis being taught the folly of attacking when the other Jedi has the “high ground“.

So…if you ever see me in person, please feel free to rib me on my missing Palpatine as the Emperor. I won’t zap you with Force Lightning…maybe.

This story was essentially proven in reverse: In March 2023, a tech billionaire named Peter Thiel started a bank run that led to the sudden collapse of Silicon Valley Bank. I was suspicious, and investigated the question, “Did this bank just collapse on purpose?”

After digging through ties to cryptocurrency, lies in the media, and several very suspicious start-ups associated with Thiel and other elites in his orbit, I eventually uncovered that these people were engaging in Ponzi schemes - not just once or twice, but likely hundreds of times.

Realizing that many of the biggest names in cryptocurrency built their careers on Ponzi schemes, the next discovery was that crypto itself was our first decentralized Ponzi scheme, with countless companies getting in on the theft.

As the list of perpetrators grew and grew, it eventually revealed a totalitarian con: Our most ‘elite’ universities built the crypto Ponzi; the biggest names in venture capital were financing the Ponzi; major news outlets all promoted the Ponzi; and prominent members of both political parties were fully complicit.

The big breakthrough around propaganda came via The Simpsons. I had proof that Harvard University was a massive organized crime front, and I recalled that many, many Simpsons writers went to Harvard. If The Simpsons is propaganda for the mafia, I asked myself, what is the point of it?

“Ay caramba!” I thought! The Simpsons brainwashed us! And if a show as popular as The Simpsons was doing it, it probably wasn’t the only one. From there, we just need some historical knowledge and critical thought to realize that we’ve been given this sort of messaging in all directions.

The other big breakthrough came when I was posting these essays on Reddit, which is owned by many of the financiers of the crypto super-Ponzi. Over and over again, I received the same types of comments that would attack my credibility without engaging with any of the evidence I was surfacing. They were practicing fear, uncertainty, and doubt. As I dug into their other comments, I found them repeatedly sowing partisanship, mocking others, and promoting products, just as a secret fascist government would want them to. This repetition from so many accounts revealed that they were coordinated trolls, poisoning our discourse and making us think they were acting in good faith.

Once we understand the totalitarian scope of the propaganda, we get to rewrite history.

The Frank case not only was a miscarriage of justice but also symbolized many of the South’s fears at that time. Workers resented being exploited by northern factory owners who had come south to reorganize a declining agrarian economy. Frank’s Jewish identity compounded southern resentment toward him, as latent anti-Semitic sentiments, inflamed by Tom Watson, became more pronounced. Editorials and commentaries in newspapers all over the United States supporting a new trial for Frank and/or claiming his innocence reinforced the beliefs of many outraged Georgians, who saw in them the attempt of Jews to use their money and influence to undermine justice.

Frank’s trial had far-reaching impacts. It struck fear in Jewish southerners, causing them to monitor their behavior in the region closely for the next fifty years—until the civil rights movement led to more significant changes. Other popular interpretations of the case include the film They Won’t Forget (1937), based on Ward Greene’s fictionalized account Death in the Deep South (1936), with Lana Turner playing the victim in her first credited screen role; the television mini-series The Murder of Mary Phagan (1988), starring Jack Lemmon as Governor John Slaton; two novels—Richard Kluger’s Members of the Tribe (1977), a detailed reconstruction of the case, but set in Savannah rather than Atlanta, and David Mamet’s The Old Religion (1997), in which a fictionalized Frank tells his story in the first person; and Atlanta playwright Alfred Uhry’s Broadway musical Parade (1999), the title a reference to both the Confederate Memorial Day parade that brought Mary Phagan to town and the lynch mob that took Frank from Milledgeville to Marietta.

In 2008 the William Breman Jewish Heritage Museum in Atlanta opened a special exhibition entitled Seeking Justice: The Leo Frank Case Revisited, and in 2009 an episode of the PBS series American Experience entitled “The People v. Leo Frank” premiered in Atlanta, where the program was also filmed.
