(1) WHAT CONSTITUTES INTENTIONAL FALSE ADVERTISING.—It is unlawful to offer for sale or to issue invitations for offers for the sale of any property, real or personal, tangible or intangible, or any services, professional or otherwise, by placing or causing to be placed before the general public, by any means whatever, an advertisement describing such property or services as part of a plan or scheme with the intent not to sell such property or services so advertised, or with the intent not to sell such property or services at the price at which it was represented in the advertisement to be available for purchase by any member of the general public.
(2) PRESUMPTION OF VIOLATION.—The failure to sell any article or a class of articles advertised, or the refusal to sell at the price at which it was advertised to be available for purchase, shall create a rebuttable presumption of an intent to violate this section.
(3) EXEMPTION.—This section shall not apply to any publisher of a newspaper, magazine or other publication, or the owner or operator of a radio station, television station or other advertising media, who places before the public an advertisement in good faith without knowledge that the person so engaging or hiring such owner, operator, or publisher has the intent not to sell the property or services so advertised or with the intent not to sell such property or services at the price at which it was represented in the advertisement to be available for purchase by any member of the general public.

⁣Ex-Marine Brian McGinnis Dragged Out of Senate After Anti-Iran War Outburst, Senator Tim Sheehy Seen Assisting

The incident has drawn attention online, with some veterans and anti-war activists expressing support for his protest

A protester was forcibly removed from a US Senate hearing on Wednesday after interrupting proceedings during an Armed Services subcommittee session. The incident involved Senator Tim Sheehy, a Republican from Montana, who was seen assisting US Capitol Police as they escorted the man from the chamber.

CBS News correspondent Alan He identified the protester as Brian McGinnis, describing him in a post on social media as a Green Party candidate running for Senate in North Carolina. He said McGinnis appeared to be wearing a US Marine Corps dress uniform.

Video of the incident shows McGinnis shouting as officers attempt to remove him from the room. At one point, he can be heard yelling: "No one wants to fight for Israel!" as he holds on to the hearing room door.

Onlookers are heard reacting in the footage. "His hand, his hand! Oh! His hand! Oh, my God. Oh, shit," one person shouts. Officers can be heard telling him: "Sir. Sir. Sir. Let go of your hand. Let go the door. Let go. Let go."

Another voice in the room says: "The senator broke his hand, a sitting U.S. Senator just broke the hand of a Marine!"

Senator Sheehy later addressed the incident in a statement posted on X. "Capitol Police were attempting to remove an unhinged protestor from the Armed Services hearing. He was fighting back. I decided to help out and deescalate the situation. This gentleman came to the Capitol looking for a confrontation, and he got one. I hope he gets the help he needs without causing further violence," he wrote.

On his campaign website, McGinnis details his service in the US Marine Corps, stating that he completed one enlistment as a Light Armored Vehicle Crewman until June 2004. He says he deployed during the initial invasion of Iraq in 2003 and later joined the All-Marine boxing team. After his discharge, he attended John Wood Community College in Quincy, Illinois, where he earned an associate’s degree in education.

The footage shows Senator Sheehy leaving the scene after the removal, at one point exchanging expletives with an audience member.
