Former Mesa County Clerk Tina Peters finally got her day in appellate court — and the results were explosive.
A three-judge panel appeared deeply troubled by major legal errors in Peters’ original trial, including:
A felony conviction based on jury instructions that described a misdemeanor
Evidence that Peters was blocked from presenting a full defense
Whether the trial judge relied on uncharged conduct during sentencing
Whether Peters was effectively punished for her protected speech
A shocking nine-year sentence for a 70-year-old non-violent first offender
Judges openly challenged the State’s argument that a person can be convicted of a crime they were never properly charged with.
“I am baffled by the position that we can somehow overlook that…” — Judge Craig Welling
They also grilled prosecutors on why Peters was not allowed to testify about her intent — even though intent is a required element of the charge.
Even Governor Jared Polis has now admitted Peters’ sentence was “harsh.”
Peters’ legal team is requesting:
Reversal of conviction
Or at minimum, resentencing before a different judge
Possible release on bond while the appeal is decided
This case has become a national flashpoint for:
⚖ Due Process
🗳 Election transparency
🇺🇸 Constitutional rights
🧱 Judicial abuse of power

The Colorado Court has officially ruled on Tina Peters — and the outcome is sending shockwaves across the country.
In today’s video, we break down the latest court decision, the clemency battle, and why many are calling this case a major test of justice in America. Despite a controversial legal fight, questions still remain about federal involvement, the Supremacy Clause, and the limits of presidential pardon power.
Was Tina Peters targeted… or held accountable?
The court upheld her conviction but threw out her 9-year sentence, ordering a resentencing after ruling that her punishment may have violated free speech protections. At the same time, the court declared that a U.S. President cannot pardon state crimes, rejecting arguments tied to federal authority.
Meanwhile, critics argue this case reveals something much bigger:
Allegations of DOJ and FBI involvement
Claims of politically motivated prosecution
A growing debate over election integrity and government power
With Tina Peters still behind bars and a new sentencing ahead, the question remains…
Is this justice—or something else entirely?
👇 Watch until the end for the full breakdown and what could happen next.
