Former Mesa County Clerk Tina Peters finally got her day in appellate court — and the results were explosive.
A three-judge panel appeared deeply troubled by major legal errors in Peters’ original trial, including:
A felony conviction based on jury instructions that described a misdemeanor
Evidence that Peters was blocked from presenting a full defense
Whether the trial judge relied on uncharged conduct during sentencing
Whether Peters was effectively punished for her protected speech
A shocking nine-year sentence for a 70-year-old non-violent first offender
Judges openly challenged the State’s argument that a person can be convicted of a crime they were never properly charged with.
