Dekraai was charged with a horrific capital crime in California. He was placed in the Orange County jail. Deputy Sheriffs moved a guy named Fernando Perez, a confidential informant, near him. They became “friends” and Dekraai allegedly made incriminating statements to him. Perez wrote down the statements and gave them to his handler, a cop. In light of the government’s conduct of obtaining these recordings, Dekraai’s lawyers filed a number of motions: 1) to dismiss the death penalty based on outrageous governmental conduct, 2) to recuse the Orange County DA’s office pursuant to a state statute and due process clause, 3) to exclude his statements pursuant to Massiah v. United States, 377 U.S. 201 (1964) (prosecution may not use evidence obtained in violation of Sixth Amendment right to counsel). The state court held an evidentiary hearing on the motions. The court heard testimony from 36 witnesses.

⁣ #bodycam #cops #police on July 4th, 2022, deputies in Florida responded to a disturbance involving an intoxicated woman disrupting traffic by walking on the road. Prior to deputies arriving, the suspect had caused a disturbance at a nearby beach resort before leaving on foot onto the roadway. Multiple beachgoers witnessed the situation as the suspect began yelling on the road, refusing to leave, leading to traffic blockages.

The situation escalated as deputies attempted to intervene and place the suspect under arrest. The suspect, refusing to cooperate with the deputies, resisted arrest, leading her to hit a deputy. The suspect continued resisting, yelling, and while being placed in handcuffs before kicking the same deputy in the groin. The suspect was placed into a patrol car as she continued to yell and kick the inside of the patrol car. The suspect was later transferred to a transport van for transportation to jail.

The suspect was charged with Resisting an Officer without Violence and Disorderly Conduct Intoxication.
